  • He has to be sworn in before he is impeached, not that this House of Representatives would do it.

    I know it won't happen with a Republican House, but it is fun to speculate whether a bill of impeachment could be based on perjury in the oath of office.

    Perjury would have to get into 18 U.S.C. § 1621, which seems. like fraud, to relate to testimony about a past act. However, since impeachment is a political act,* I'm sure breaking the oath would be sufficient.
