A woman is suing Menards after a fireplace allegedly fell on her.

Maria Martinez says that on August 6, 2007, while shopping in the HVAC department at Menards, "a fireplace fell from a shelf causing injury to [Martinez.]"

Lawsuit: Injured when Akon jumped into audience at concert

A woman has filed a lawsuit related to injuries she says she sustained at an Akon concert.

Holly Duncan says that on June 13, 2009, while at the "B96 Summer Bash" at Toyota Park, Akon leapt into the crowd during his performance of "Right Now," at which point there was a crowd swell and people who crowded around the stage surged backwards. 

It was then that a girl fell backwards in the direction of Duncan, who reached out with her right arm to brace the person's fall and prevent the person from falling on Duncan and her sister, the complaint states.

Lawsuit: Injured by cart full of Hostess baked goods

A woman is suing Hostess Brands and its employee for injuries she says she sustained when the employee pushed a cart into her and caused her to fall.

Patricia Armanetti says that on February 28, 2009, while shopping at Dominick's in Park Ridge, the following occurred:

- Defendant Jack Drury, an agent of Hostess Brands, was pushing a cart of bakery items.
- Bakery items fell off the cart Drury was pushing.
- As Drury attempted to catch the bakery items, he pushed the cart into Armanetti, causing her to fall.

Lawsuit: Exposed to toxic fumes on American Airlines flight

A woman is suing American Airlines after allegedly being exposed to toxic fumes during a flight, causing her to suffer a nearly fatal stroke.

Vida Chenier says that on March 26, 2008, she was a passenger on American Airlines Flight 2073 from O'Hare to San Juan, Puerto Rico, when the following occurred:

- Toxic fumes or contaminated 'bleed air' allegedly entered the passenger cabin through the aircraft's ventilation system. 
- Chenier began experiencing hypoxia, also known as oxygen deprivation, as well as difficulty breathing and began to cough violently and develop a severe headache.
- In the two days following her arrival in San Juan, Chenier's symptoms worsened and on March 29, 2008, she began to cough up blood.
- On April 4, 2008, Chenier suffered a nearly fatal stroke.

Lawsuit: Struck in the head by armrest at movie theater

A woman is suing a Niles, Illinois movie theater for injuries she says she sustained after the armrest struck her in the head when she bent down to answer her telephone.

Taj Showers says that on June 14, 2008, while at the Kerasotes Niles Showplace 12 for the matinee viewing of the "Incredible Hulk" with her son, she bent down to "discreetly answer her telephone" when the armrest of her seat "suddenly dropped from its upright position and struck her on the head."

Woman says Wal-Mart employee threw box in her direction, caused fall

A woman is suing Wal-Mart for injuries she says she sustained after an empty box was thrown in the aisle she was in and caused her to fall.

Rebecca Alter says that on April 16, 2009, while shopping at the Wal-Mart in Hodgkins, she was discussing the purchase of a hunting/fishing license in the Sporting Goods department with Wal-Mart sales associate defendant Rebecca Snyder when the following occurred:

- Snyder asked Alter to come around the counter into the aisle and she did so.

- Defendant Susan Sherrie was stocking merchandise in the adjacent aisle.

- As Alter was walking into the aisle adjacent to the counter, Sherrie threw a box she had just emptied of merchandise down the aisle and it slid into the travel path of Alter. 

- Alter stepped into the opened, empty box and fell back onto the floor.

Woman sues bar over pineapple juice in drink, allergic reaction

A woman says a bar put pineapple juice in her drink despite her requests that it be excluded and it caused her to suffer an allergic reaction.

Dorinda Lawrence says that on March 28, 2008, while a patron at Green Dolphin Street, she ordered a beverage "specifically requesting multiple times that pineapple juice be excluded from the drink," but was sold and served a beverage containing pineapple juice, which she consumed and then suffered an allergic reaction.

Woman trips on piece of wood at Jewel, was distracted by vegetables

A woman is suing Jewel Food Stores for injuries she says she sustained when she tripped and fell on a piece of wood that was left on the floor.

Halina Dymora says that on March 9, 2008, while at a Jewel Food Store in Niles, she tripped and fell on a piece of wood on the floor "as she approached the produce department" and "was unaware of the presence of the piece of wood as her attention was directed at the vegetables in front of her."

Lawsuit: Atlantis picked wrong tile for rainy Bahamas

A woman is suing the Atlantis Resort in the Bahamas after she slipped and fell on outdoor tile.

Nancy Wietek says that on February 25, 2008, while a guest at the resort, she slipped on "wet and excessively slippery tile of an outdoor walking path."

According to the complaint, the resort was negligent when it, among other things, failed to "adequately inspect and make safe the premises for hazards, when reasonably anticipated events like rain showers, which occur with some frequency in the environment, made the tile excessively slippery" and when it failed to "requir[e] that an appropriate tile be installed for the environment in which it is used."

Lawsuit: Hit in the head with a hockey puck at Chuck E. Cheese

A woman is suing Chuck E. Cheese after allegedly being struck in the head with a hockey puck.

Reyna Mason says that on February 22, 2008, while sitting in a booth near an air hockey table at Chuck E. Cheese, she was struck in the head by a hockey puck.

The complaint states that the defendant was negligent when it, among other things, "failed to warn [Mason] of the danger posed to her by sitting in a booth near the air hockey table" and "failed to have adequate safety precautions in place for those sitting in booths near the air hockey table."

Woman sues Lettuce Entertain You after waiter drops plate on her

A woman is suing Lettuce Entertain You after a waiter allegedly dropped a plate on her at one of its restaurants.

Ann Soderman says that on December 1, 2004, while seated at a dining table at Wildfire Restaurant, a waiter dropped a large plate that struck her wrist.

According to the complaint, the waiter and restaurant were negligent when he, among other things, "failed to secure the plates while carrying them" and "attempted to carry more plates than was reasonable safe and prudent to do so."

Man walks into "glass partition/wall" at Sears, sues

A man is suing Sears for injuries he says he sustained when he walked into a "glass partition/wall" at the store.

Nikiforos Diamantis says that on February 23, 2008 while at Sears, he "walked into a glass partition/wall that was unmarked and not easily seen to members of the public, that was placed on the floor by an authorized agent and employee of defendant, Sears, which was on the premises of the defendant, Sears."

The complaint further states that Sears "had a duty to reasonably maintain its premises from objects, glass partitions and/or other materials which would make the aforesaid premises unsafe to traverse by customers in its stores."

Woman trips on small traffic cone, sues

A woman is suing Oakdale Christian Academy for injuries she says she sustained after she tripped over a small traffic cone in the school's parking lot walkway.

Annie Wilson says that on February 13, 2008, she "tripped and fell on a small traffic cone placed into the designated walkway of said premises."

The complaint states that the school, among other things:

- Failed to warn plaintiff that the parking lot walkway was not level and dangerous
- Placed a traffic cone in the designated walkway blocking access
- Failed to properly guard plaintiff from the foreseeable dangers posed by placing a cone into the designated walking path.

Lawsuit: Stepped on a barrel at Crate & Barrel

A woman is suing Crate & Barrel for injuries she says she sustained after she "stepped on a barrel."

Mary Lou Beckers says that, while at the Crate & Barrel Outlet Store in Naperville, she "stepped on a barrel that was sticking out in the aisle area, causing her to fall and sustain serious injuries."

The complaint states that the store was negligent when it, among other things, "failed to provide a warning sign."

Student sues CPS after she is hit with a brick

A CPS student who was allegedly hit with a brick while riding the school bus is suing CPS.

Akiya Johnson, who is now an adult, says that from November or December of 2004 through January of 2005, her school bus drove each day through an intersection where, on more than one occassion, unknown individuals threw snowballs and rocks at the bus. 

According to the complaint, Johnson's mother called defendants regarding the attacks, but no route adjustment or other corrective measures were taken.

On February 22, 2005, at least one rock and/or brick was thrown at the bus, broke the window and struck Akiya Johnson in the left eye, the complaint states.

Johnson is also suing, among others, the Board of Education and the individual bus driver.

Inmate slips on overflowing toilet water, sues Sheriff

A Cook County jail inmate is suing the county and sheriff after he allegedly slipped and fell on water in his cell after the toilet overflowed.

Ricky Robinson says that on February 9, 2009, he was "lawfully on said premises, being an inmate in Cell number L-104" when he was "caused to slip and fall due to the water accumulated on the floor of his cell when the toilet overflowed."

The complaint states that the county and sheriff were negligent when they, among other things, "failed to repair the toilet even after the Plaintiff complained that it overflowed onto the floor of the cell" and "failed to warn Plaintiff of the dangerous condition of the toilet."

Woman sues Metra over exploding toilet

A woman is suing the Metra for injuries she says she sustained when a train toilet malfunctioned.

Julianna Mandernach says that when she was a passenger on the Metra line from Chicago to Joliet/Rock Island, she flushed the toilet and "contents of the toilet exploded out of the toilet and splattered the plaintiff."

The complaint states that Metra, among other things, failed to repair and replace the toilet when it knew or should have known it was in need of replacement or repair.

Lawsuit: Injured at the Brad Paisley concert

A woman is suing Live Nation, among other defendants, after she was allegedly injured when a fight broke out at a Brad Paisley Concert.

According to the complaint, Mollie Ralph was attending the Brad Paisley concert at the First Midwest Bank Ampitheater when a fight broke out and she was knocked to the ground and injured.

The complaint further states that Live Nation sold alcohol to these individuals and "the alcoholic liquors consumed by these certain individuals caused or contributed to cause in their intoxication," and "while intoxicated, and as a result of their intoxication, these certain individuals started a fight at [the theater] resulting in injuries to Plaintiff."

The complaint also asserts Live Nation was negligent when it, among other things, "failed to provide an adequate number of security personnel at the concert" and  "failed to properly break up a fight at the concert."

Woman sues Target after slipping on a "plastic pillow encasing"

A woman is suing Target for injuries she says she sustained after slipping on a "plastic pillow encasing located on the floor."

Alana Andrews says that while shopping at the store, she "was caused to sustain serious and severe injuries to her body when she slipped and fell on a plastic pillow encasing located on the floor in an aisle of [Target's] store."

The complaint further states that Target was negligent when it, among other things, "carelessly and negligently failed to remove obstructions from the store aisle," and "carelessly and negligently failed to barricade or warn Plaintiff of one plastic pillow encasing on the floor where customers, including Plaintiff, were walking."

Man sues Morton's Steakhouse over smoke inhalation

A man is suing Morton's Steakhouse after he was allegedly forced to ingest smoke during his meal due to an apparent fire in the restaurant.

James F. Novak says that on April 17, 2009, a fire developed in the restaurant and smoke permeated throughout.  The complaint states that the restaurant incorrectly told him that there was no fire, that the subway was causing the smoke and there was nothing to worry about.

The complaint further states that the resturant "insisted that Novak pay his bill before he left."

Woman slips on butter at movies, sues theater

A woman is suing the River Oaks 6 Movie Theater for injuries she says she sustained when she slipped and fell on butter.

Sonya Williams says the theater "allowed the premises to remain in a dangerous and unsafe condition, causing [her] to fall on butter on the floor in the walk-way of said premises."

The complaint also states that the theater failed to "post proper warnings of the dangerous condition that existed."

Woman says table at Kmart collapsed on her

A woman is suing Kmart for injuries she says she sustained after a table holding towels fell on her.

Lynda Parquet says that while she was at the Kmart in Forest Park, she was "struck by a table holding towels that collapsed" and "causing her to stumble and fall sustaining injury [to] her left side, foot and ankle."

The complaint asserts that Kmart was negligent when it, among other things, "carelessly and negligently piled up towels on a table that could not hold the towels."

Woman sues after tripping over parking bumper

A woman is suing over injuries she says she sustained after tripping over a parking bumper at a Lake Zurich Citgo station.

Gael Loncrini says that she tripped and fell over a parking bumper in the parking lot of the Citgo, causing severe injuries.  The complaint states that the bumper was a violation of a local ordinance prohibiting "obstructions in the Public Right of Way."  The complaint also states that the Citgo was negligent when it, among other things, failed to paint or properly mark the obstruction.

Motorcyclist sues city for pothole on Wacker

A motorcyclist is suing the City of Chicago for a pothole on Wacker Drive that caused him to crash.

Myron Reed says that, while operating a motorcycle headed eastbound in the left hand lane of Lower Wacker Drive on August 30, 2009, there was "an area of the roadway that had been cut out and was depressed and uneven making it dangerous to motorists."

The complaint states that the wheels of Reed's motorcycle "made contact with the edge of the uneven roadway causing him to lose control and crash."

The complaint asserts that the city was negligent when it, among other things, "created an uneven driving surface on Lower Wacker Drive."

Woman sues DirecTV after tripping over cable wire in her home

A woman is suing DirecTV over injuries she says she sustained after tripping over a cable wire in her bedroom that she allegedly asked the company to fix more than once.

Emilia Alcala says that on January 8, 2008, she had satellite television installed in her home and one week later, she tripped over the wires in her bedroom and fell. 

Alcala asserts that defendants were negligent when they improperly installed cables so that they constituted a tripping hazard and failed to correct the improper installation after being repeatedly asked to do so.

Woman sues Westin after heel of shoe is caught on carpet

A woman is suing the Westin on Michigan Avenue for injuries she says she sustained when the heel of her shoe caught on the carpet of the stairs and caused her to fall down the steps.

 

Patricia Kocenko says that on May 2, 2008, she was attending a convention at the Westin and was descending a staircase when the carpet on the stairs caught the heel of her shoe, breaking the heel off of her shoe and causing her to fall down the stairs.

 

The complaint asserts that the Westin was negligent when it, among other things, "permitted a defective carpet to exist."

Man injured in car chase sues city

A man injured during a high speed police chase is suing the city and the cop who was driving the police vehicle during the pursuit.

 

David Martinez says that, while he was driving southbound on Western Avenue, the police vehicle operated by defendant police officer Dean Angelo was speeding, weaving in and out of traffic and ran a red light, colliding with Martinez's vehicle.

 

The complaint states that the defendants were negligent when they, among other things, "knowingly and with conscious disregard for the safety of others, initiated and continued a high speed vehicle chase or pursuit through residential and commercial streets in Chicago."

 

The complaint states, presumably in error, that the above took place on December 31, 2009.  One paragraph does state December 31, 2008.  The complaint also refers to the plaintiff on page 5 as Pedro V. Salgado.

Woman sues Home Depot after fall from three step ladder

A woman is suing Home Depot after falling from a three step ladder provided to customers to access merchandise.

Marjorie Howard says that on April 10, 2008, she used a three step ladder at Home Depot that was made available for customer use to access merchandise stored on an overhead shelf when the ladder became unstable causing her to fall.

Howard asserts, among other things, that Home Depot was negligent when it "failed to provide adequate customer service so as to assist its customers in obtaining merchandise located at heights unreachable without the use of a step ladder or other device."

When it rains, it pours

A man is suing the leasing agent of the Ogilvie train station after a slip and fall resulting from a leak in the roof.

According to the complaint, on September 14, 2008, it was raining heavily in downtown Chicago and water leaked onto the floor from the roof, causing plaintiff Dale Blackwell to slip and fall and become injured.  There were no signs indicating that the floor was wet, the complaint states.

This is not the first time the leasing agent has been sued for a slip and fall in Ogilvie train station due to a leaking roof and wet floor.  Plaintiff's attorney obtained a settlement this past February for another individual under similar circumstances at the same station.  Read about it here.

Richard Reck says that on December 3, 2007, he bit into "the stone/pebble concealed in/amidst the previously sealed and unopened bag of popcorn" and suffered serious, ongoing and permanent dental injury.

A man is suing Hilton after he tripped on an "unattended piece of luggage."

Plaintiff Richard J. Wood alleges that on October 7, 2007, while he was a guest at Palmer House on Monroe Street in Chicago and was "walking in, at or near an executive level floor area snack or guest room and/or concierge desk," he tripped over luggage in said area.

The complaint asserts, among other things, that defendant Palmer House Hilton Hotel had a duty to "maintain said hotel area in a safe condition, free of luggage left unattended and posing as an obstacle to guests walking at or near said area of the hotel."

A woman is suing a Comfort Inn in Skokie for injuries she said she sustained when she slipped and fell in the pool area due to "an unnatural accumulation of water."

According to the complaint, on September 22, 2007, plaintiff Deborah Myles was at the hotel when she slipped in the pool area and "attempted to grab a rail to stop her fall, causing [her] to suffer injuries."

The complaint states that the defendant was negligent when it, among other things, "failed to inspect said ground when such inspection would have revealed water in said pool area on said ground and that said water was in a dangerous, hazardous and unsafe condition," and "carelessly and negligently created the dangerous slippery condition in the pool area."

Woman Sues Sears After She Slips On Vomit

A woman sued Sears today for injuries she alleges occurred when she slipped and fell on vomit while in the television department.

According to the complaint, on July 11, 2009, plaintiff Glinda Bridgeman was a customer at the Sears Department Store on West 95th Street when she slipped and fell "due to vomit and paper towels that were placed on the floor by an authorized agent and employee of defendant."

The complaint further asserts that Sears was negligent when it, among other things, "failed to warn customers of the presence of the vomit and paper towels on the floor," and "failed to clean the vomit and paper towels after it knew or should have known that the vomit and paper towels presented a danger to its customers."

Woman Hit By Shopping Cart Sues Jewel

A woman filed a lawsuit today against a supermarket for injuries she says she sustained after being struck by a motorized shopping cart.

Plaintiff Raquel Goffin asserts that, while she was in the TCF bank area located within the Jewel food store on North Narragansett in Chicago, she was "struck in her back by a Jewel customer operating a motorized shopping cart."

Goffin alleges, among other things, that Jewel Food Stores "failed to warn the Plaintiff of the dangerous condition of the area which allowed persons to operate motorized shopping carts in the TCF counter area thereby causing a danger to the TCF customer."

Goffin is suing Jewel Food Stores, Supervalue and TCF.

St. Ignatius College Prep Sued After Hazing Incident Paralyzes Boy

A boy and his family are suing St. Ignatius College Prep with respect to a hazing incident at the school which the complaint states left the young man quadriplegic.

The complaint states that on February 28, 2007 the plaintiff was participating in water polo practice when other students began throwing objects at him.  While this was happening, he was told my a St. Ignatius agent to "get in" the pool.  He dove in, hit the bottom and suffered injuries that have left him quadriplegic.

Franklin Park Bar Sued for Overserving that led to DUI Injury

Sneakers Sports Bar & Grill in Franklin Park was sued today for allegedly serving alcohol to a man who then drove drunk and caused injury to Plaintiff Allen Warner.
