A woman is suing DirecTV over injuries she says she sustained after tripping over a cable wire in her bedroom that she allegedly asked the company to fix more than once.
Emilia Alcala says that on January 8, 2008, she had satellite television installed in her home and one week later, she tripped over the wires in her bedroom and fell.
Alcala asserts that defendants were negligent when they improperly installed cables so that they constituted a tripping hazard and failed to correct the improper installation after being repeatedly asked to do so.

Legally, isn't there an open and obvious hazard defense here (at least since it is pleaded in tort instead of contract)?
