Marriott sued over ATM fee

A man is suing Marriott in a class action lawsuit filed today over failure to provide notice of a $2.50 service charge at an ATM in one of its hotels.

Frederick Brill says that when he used the ATM at the Marriott Lincolnshire in Lincolnshire, Illinois, there was no posted fee notice on or near the ATM but he was charged $2.50.

The complaint asserts that this is a violation of the Electronic Funds Transfer Act requiring ATM operators to provide notice - either in the form of a posted fee notice or on the ATM screen - that the operator will impose a fee.
