Man sues cemetery after headstone falls on his feet

A man is suing Mount Olive Cemetery after a headstone fell on his feet and his daughter's.

Alexander Valdivia was visiting his brother's gravesite with family members when the headstone, which was "carelessly left propped-up by a metal pole on an incline adjacent to the gravesite," tipped and fell over onto the feet of plaintiff and his minor daughter, the complaint states.

The complaint references photographs of the exact area of the incident but they are not attached as exhibits to the complaint.
