Headache doctor blamed for suicide

The estate of a young woman who committed suicide is suing a doctor who treated her for chronic headaches.

According to the complaint, Hilary Waltmire, a minor, was treated for severe and chronic headaches by Dr. Merle Diamond from April 2007 through the date of Hilary's suicide in October 2007. The complaint asserts that Dr. Diamond, among other things, failed to warn Hilary's parents that certain medications she was taking for her headaches could result in an increased risk of suicide.

Suicide claims are tough. As a plaintiff, you're already starting behind the eight ball as a jury in Illinois is able to consider that the plaintiff contributed to his own death and compare the plaintiff's own negligence against the negligence of the defendant(s). It's very hard to get an entire jury of 12 people to completely absolve someone of fault when ultimately, they are the one who has caused the injury to themselves.
