Discrimination forced Mexican man to quit

A man of Mexican national origin is suing his former employer for discrimination, which he says included being called a "stupid Mexican" and being threatened with physical violence.

Juan Miramontes was a mechanic for Great Kitchens and was promoted after less than a year with the company but he says he was subjected to discrimination when the following occurred during the course of his employment:

- Robert Aleman, a mechanic of Honduran national origin, made comments to Miramontes such as "stupid Mexican" and "Mexicans don't know what the f-ck they're doing around here."
- Aleman said "I've never cowered down from a Mexican and I never will and if any of you guys want to prove it let's go."
- Aleman approached Miramontes and two other Mexican mechanics and "poked one in the buttocks simulating anal rape."
- Aleman instigated racially motivated violence against Mexican employees and then bragged about it.
- Aleman threatened to "'kick' Plaintiff's 'ass'" and followed Miramontes around after his shift ended and made threats of physical violence.
- Aleman "violently grabbed Plaintiff, pulled Plaintiff toward Aleman and kissed Plaintiff on the lips."

During the course of his employment, Miramontes spoke to his supervisor and to the plant manager about Aleman's behavior, but Aleman was never disciplined.

Miramontes felt that he was left with no choice but to resign, which he did, providing 2.5 weeks notice to Great Kitchens.

It was after Miramontes provided notice of his resignation that the kissing incident occurred with Aleman and when Miramontes met with Human Resources about it, supervisor Julio Martinez, who is of Honduran descent said "It's only the Mexicans that do that here and they've always done it," the complaint states.

Juan Miramontes is not telling the whole truth in his claims. He fails to mention that he claims to be relocating to a new state thats why he quit. He's an arrogant know it all! He has a tendency to put down his fellow workers. He pretends to be so much better than everyone else. He rubs people the wrong way with his attitude and sarcasm. Theres two sides to every story and your only getting one.He also claims to have another lawsuit pending with a previous employer.
