According to the complaint, plaintiff George Alpogianis was at one time a defendant in the criminal division but the charges were dropped or reduced to misdemeanors. Still, on May 29, 2009, about a month after he was elected Trustee, he received a letter from Alvarez's office stating that they were aware that in 1985 he was convicted of aggravated battery, a class 3 felony. The letter, attached as an exhibit, further states that Alvarez's office will bring an action to oust Alpogianis if he doesn't resign and can fine him up to $25,000.
Alpogianis asserts that he could not gain access to the official records to show that he was not convicted of any felony and so resigned on June 19, 2009. Now, he wants, among other things, the official record corrected and for Alvarez to stop holding out to the world that he is a felon.
