Kane will take a plea deal, but cabbie wants a personal apology

legal_scales2.jpgThe Buffalo News is reporting Tuesday morning that, according to law enforcement officials, the Blackhawks' Patrick Kane is expected to agree to a plea deal in the next few days after he and his cousin, James, are indicted on a misdemeanor criminal charge.
The speculation is that the Kanes would plead guilty to something such as harassment or disorderly conduct. Or they might be granted an adjournment, the newspaper said, that could have the charges eventually dropped altogether if Kane doesn't get himself in more legal trouble in the next six months.
Cabbie Jan Radecki wants Kane to apologize directly to him, said Radecki's lawyer, Andrew C. LoTiempo. The Kanes were charged with robbery and criminal mischief after an altercation with Radecki in his cab in the early morning hours of Aug. 9.
"He does not want (the Kanes) to have a criminal record," LoTiempo said. "He does not want them to have any jail time. He does not want to ruin Patrick Kane's career. My client is looking for a direct apology to him, not much more."

In other words, as many of us predicted, Kane will be forced to apologize, perhaps do community service and pay the cabbie his expenses as part of his restitution.
The money exchange will be watched closely by outside observers, because from the start it was speculated that there would be a payoff to get Kane out of this mess. They will make it look more legal than that, but it comes down to a payoff.
If this turns out to be the case, Kane also will be apologizing for the second time this week. On Monday, before Team USA Hockey practice at Woodridge, he apologized to the Blackhawks, their fans, his family and the cities of Chicago and Buffalo for being in the wrong place at the wrong time.
Kane didn't include an apology to Radecki in his statement, but apparently will have to be convinced by his lawyer to do so if he wants the plea agreement.
Kane will be finished with the Team USA orientation camp Wednesday. Look for the plea agreement and his apology to Radecki to come quickly after that.
Since Kane was still making noises Monday about not getting his side of the story out yet, that might not totally sit well with him. But Kane might have to understand that sometimes you are forced to do something you don't want to do, just to make it all go away.
Kane might be best advised to keep his side of the story to himself and not share it in a public forum. Apologizing to Radecki and then dissing him afterward wouldn't be the right way to deal with the court.
Reporters will be after Kane all year to cry on their shoulder. We'll see how grown up the 20-year-old can be by keeping his own counsel and not spilling what he knows to make himself look better.
The Buffalo News previously reported that a source said Kane called Radecki "a scumbag" in the police report. Radecki may have kept the cab doors locked during a fare dispute with the Kanes.
The Kane apology to Radecki would be the most interesting part of this case. Will it sound at all sincere or will Kane be issuing an apology without feeling sorry for his actions?
Roll the tape and we'll break down the film. After all, football season is here. We can all determine if Kane is apologetic for real or apologetic just to get off the hook.

Maybe the whole cast and crew of this freak show can have one final episode with Radecki in new glasses Kane paid for--since his were broken in the cab fracas--and everybody singing "The Hockey Song" as a parting gift.

Mike, hopefully one thing P-K derives from all of this is 'do your partying within staggering distance of home'. It doesn't pay to put your fate in the hands of your macho cousin and an ornery taxi driver.

Not so fast. I think the apology to the cabbie could be the finest moment in all of this. A guy you call a scumbag just last week and now you have to bow down before him and say "I'm so sorry Mr Scumbag for all the trouble I caused." Kane might be fighting mad about this. Oh, no, it's Patrick Kane. I guess fighting mad wouldn't be right. But I bet he's pissed about having to apologize to the cabbie. That's so personal, unlike apologizing to entire cities and organizations.

If he had apologized to the cabbie yesterday, it could have been construed as an admission of guilt.
The apology isn't any big deal, we're all guys, we've all said "I'm sorry" when we weren't.

Bottom line is, no felony conviction. When international travel is a big a part of your job as it is Kane's, that's not a small consideration.

Good thing Patrick got a kick out of watching those Michael Vick "I'm sorry" tapes, he'll have some homework to do.

A plea bargain will be perceived as an admission of guilt, however it's not a cut and dry thing. Pleas are agreed to for any number of reasons. In this case, it can be spun (for the Kane side) that yes this whole thing has been blown out of proportion but neither side feels its in their best interest to drag this out, so they'll settle out of court and keep terms confidential. But I could see Jan Radecki's condition of request for a public apology as a sticking point. Kane wants to come out of this as unscathed as possible and a direct apology, no matter how carefully worded, will come across as an admission of guilt in the court of public opinion.

Among the things 20-year-olds aren't good at is apologies for acting in ways they see as just kind of normal crazy. Kane's lawyer is going to earn his money coaching him to say the right thing in the right way and with the right facial expression to make it all seem like it was Kane's idea to say this in the first place. Learning to fake it sincerely is an art. Maybe Kane has the talent. We'll see.

I don't know what all the fuss is about Patrick Kane. Sure this kid made a mistake. So did our famous olympic swimmer star. Getting back to hockey, Patrick Kane antics are lame compared to Bob Probert or Theo Fluery back a decade or so ago
